These terms apply to the website located at auburnconcretecontractor.com and to all services provided by Advanced Auburn Concrete.
By using this website or requesting services from Advanced Auburn Concrete, you agree to be bound by these terms and conditions. If you do not agree to any part of these terms, please do not use this website or engage our services. We may update these terms from time to time, and your continued use of this website after any update constitutes acceptance of the revised terms.
Advanced Auburn Concrete provides residential and commercial concrete contracting services in Auburn, AL and surrounding areas. Our services include but are not limited to concrete driveways, patios, sidewalks, foundations, slabs, retaining walls, pool decks, steps, parking lots, decorative and stamped concrete, and concrete cutting.
All work is performed by our crew or by subcontractors under our supervision. We reserve the right to decline any project at our discretion.
All estimates are provided in writing following an on-site evaluation. Verbal estimates are not binding. A written estimate reflects the scope of work discussed at the time of the site visit and is valid for 30 days from the date it is issued.
The price in a signed written contract is the price you pay, provided the scope of work does not change. If you request additional work or if unforeseen conditions are discovered during the project - such as buried debris, unsuitable soil, or underground utilities not identified before work began - the additional cost will be discussed and agreed upon in writing before any extra work proceeds.
Material prices are subject to market conditions. If significant price increases occur between the estimate and the project start date, we will notify you before proceeding.
Project scheduling is confirmed after a signed contract and any required deposit are received. We make every effort to start and complete projects within the agreed timeline. Weather, permit delays, supply chain issues, and other conditions outside our control may affect scheduling, and we will communicate any changes to you promptly.
If you need to cancel or reschedule a project, please notify us as soon as possible. Cancellations made after materials have been ordered or after work has begun may result in a charge for costs already incurred, including materials, permits, and labor for work completed.
We reserve the right to reschedule work due to weather conditions that would compromise the quality of the finished product, including extreme heat, heavy rain, or freezing temperatures.
Payment terms are specified in the written contract for each project. In general, a deposit may be required before work begins, with the remaining balance due upon completion of the project. Final payment is due on the day the work is finished, before our crew leaves the site.
We accept payment by cash, check, or other methods as specified in the contract. Returned checks are subject to a returned check fee.
Accounts not paid within 30 days of the invoice date may be subject to a late fee and may be referred to a collections process. In the event we must pursue legal action to collect unpaid amounts, you agree to reimburse us for reasonable attorneys' fees and court costs.
We stand behind our work. If a defect in workmanship is identified within one year of project completion, we will address it at no charge. This warranty covers defects directly caused by our installation, not damage resulting from normal settling, soil movement, tree root growth, vehicle impact, improper use, or conditions outside our control.
Concrete is a natural material and minor surface cracking is normal. Hairline cracks that develop along or near control joints during the curing and settling process are not covered under this warranty, as they are an expected characteristic of concrete.
Beyond our workmanship warranty, all services are provided as-is. We make no additional express or implied warranties regarding the fitness of our services for any particular purpose beyond the scope of work described in the signed contract.
Our total liability to you for any claim arising from services we provide shall not exceed the amount you paid us for the specific project giving rise to the claim.
We are not liable for indirect, incidental, or consequential damages, including lost income, loss of use of your property, or costs of substitute services, even if we have been advised of the possibility of such damages. Some states do not allow the exclusion of consequential damages, so this limitation may not apply to you in full.
You are responsible for disclosing any known underground utilities, irrigation systems, septic lines, or other subsurface conditions in the work area before we begin. We call 811 to have utilities marked before any digging, but private utilities and systems not registered with the utility notification service are your responsibility to identify and communicate to us.
You are also responsible for ensuring that the project complies with any homeowners association rules or deed restrictions that apply to your property. We are not responsible for violations of HOA rules arising from work you have authorized us to perform.

If a dispute cannot be resolved informally, both parties agree to submit the matter to non-binding mediation before pursuing litigation. Any legal action must be filed in the courts of AL, in the county where the work was performed.
These terms and conditions are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any legal proceedings arising from these terms shall be conducted in the State of Alabama.
